1: Part A Standard information form for package travel contracts where hyperlinks can be used

The combination of travel services offered to you is a package within the meaning of Directive (EU) 2015/2302 and Article L.211-2 II of the French Tourism Code.

You will therefore benefit from all the rights granted by the European Union to packages, as transposed into the French Tourism Code. Magic Ways and the organizer are fully responsible for the proper execution of the entire package.

In addition, as required by law, Magic Ways and the organizer have protection to refund your payments and, if transportation is included in the package, to ensure your repatriation in the event that they become insolvent.

Travelers will receive all essential information about the package before entering into the package tour contract.

Both the organizer and the retailer are responsible for the proper execution of all travel services included in the contract.

Travelers are provided with an emergency telephone number or point of contact to reach the organizer or retailer.

The package price may only be increased if specific costs increase (e.g. fuel prices) and if this possibility is explicitly provided for in the contract, and in any case may not be changed less than twenty days before the start of the package.

If the price increase exceeds 8% of the package price, the traveler may cancel the contract.

If the organizer reserves the right to increase the price, the traveler is entitled to a price reduction in the event of a reduction in the corresponding costs.

Travelers may cancel the contract without paying cancellation fees and receive a full refund of payments made if any of the essential elements of the package, other than the price, undergoes a significant change. If, prior to the start of the package, the professional responsible for the package cancels it, travelers have the right to obtain a refund and compensation, if applicable.

Travelers may cancel the contract without paying a cancellation fee before the start of the package in the event of exceptional circumstances, for example if there are serious safety issues at the destination that are likely to affect the package.

In addition, travellers may cancel the contract at any time prior to the start of the package, subject to payment of an appropriate and justifiable cancellation fee.

If, after the start of the package, important elements of the package cannot be provided as planned, appropriate alternative services must be offered at no extra charge.

Travelers may rescind the contract without paying a rescission fee if the services are not performed in accordance with the contract, if this significantly disrupts the execution of the package and if the organizer fails to remedy the problem.

Travelers are also entitled to a price reduction and/or compensation in the event of non-performance or poor performance of travel services.

The organizer or retailer must provide assistance if the traveler is in difficulty.

If the organizer or retailer becomes insolvent, the amounts paid will be refunded. If the organizer or retailer becomes insolvent after the start of the package and transportation is included in the package, repatriation of travelers is guaranteed. Magic Ways has taken out insolvency protection with APST. Travelers may contact this entity (APST 15 avenue Carnot, 75017 PARIS, 01 44 09 25 35, info@apst.travel) if they are denied services due to the insolvency of Magic Ways.

If, after the start of the trip, important elements of the trip cannot be provided as planned, appropriate alternative services must be offered at no extra charge.

Travelers may cancel the contract without paying a cancellation fee if the services are not performed in accordance with the contract, the trip is significantly disrupted and the service provider fails to remedy the problem.

Travelers are also entitled to a price reduction and/or compensation in the event of non-performance or poor performance of the travel service.

The service provider or retailer must provide assistance if the traveler is in difficulty.

If the service provider or retailer becomes insolvent, the amounts paid will be refunded. Magic Ways has taken out insolvency protection with APST.

Travelers can contact this organization if they are denied services due to the insolvency of Magic Ways.

GENERAL TERMS AND CONDITIONS OF SALE (B2C) as of February 1, 2019

Preamble

The terms and conditions of all Magic Ways services meet the requirements of law n°92-645 dated July 13, 1992, setting the conditions for the exercise of activities relating to the organization and sale of tourist tours, travel packages and activities, and are governed by articles R.211-5 to R.211-13 of the French Tourism Code.

Magic Ways reserves the right to modify these terms and conditions of sale without prior notice in order to comply with current legal and regulatory provisions.

Schedules, programs, durations and prices are subject to change without notice.

In compliance with Article 16 of European Directive n°2011/83/EU, adopted on October 25, 2011, concerning consumer rights, and Article L211-28 of the French Consumer Code, the right of withdrawal granted to consumers is excluded for leisure activities.

Article 1 – Booking

All tours and excursions require advance booking, including multi-stop Bus Passes (Open Tour, Big Bus).

All bookings imply acceptance of these General Terms and Conditions of Sale.

Reservations will only be considered effective once the customer has received the voucher or booking confirmation sent by magicways.fr or its affiliated sites.

Reservation requests can be made via our website https://magicways.fr, by e-mail to contact@magicways.fr or by telephone on 01 40 06 88 00.

It must specify: the tour code and name, the date, time and language of the desired tour, the number of participants (adults, children and babies), the customer’s surname, first name and date of birth, the full pick-up address for Premium or pick-up tours, and the customer’s telephone number and e-mail address, so that they can be contacted in an emergency.

Reservations can also be made directly at our agencies (Article 16: Our agencies).

The data collected from the customer will be the same as those required when booking through the reservation center.

Reservations with pick-up at place of residence :

For all bookings involving pick-up at the customer’s place of residence, information concerning the customer’s accommodation address and telephone number must be sent by e-mail to contact@magicways.fr at least 48 hours before the date of the tour.

For bookings made within 48 hours of the tour date, please contact the call center on 01 40 06 88 00.

If this information is not provided, the order will be processed by our Agence des Pyramides (see article 16).

No refund will be given.

Pick-ups can only be made in Paris Intramuros (postal code 75XXX).

Article 2 – Cancellation policy

  • For bookings made via the website :

All cancellation requests must be sent to magicways.fr via the contact page (Individuals/My question concerns a reservation made on the magicways.fr website/I wish to cancel my reservation for a bus/minibus tour), specifying the reservation number, your name and the date.

We will process your request as quickly as possible.

  • For all other reservations:

All cancellations of tours and excursions must be sent by e-mail to contact@magicways.fr

No cancellations will be accepted by telephone.

Cancellation fees will be calculated on the date of receipt of the e-mail and according to the following table:

– The voucher is nominative: the holder of the voucher is requested to bring valid identification with him/her, as it may be requested at the park entrance;

– Reservations must be made at least 12 working days before we collect the tickets from Disneyland.

Magic Ways reserves the right to cancel or modify certain tours without prior notice if the comfort or safety of passengers so requires, particularly in the event of force majeure, strike, natural disaster, cultural event, administrative decision or exceptional closure. Force majeure is defined as any event external to the affected party, unforeseeable, irresistible and insurmountable, which prevents Magic Ways from performing all or part of its obligations under this contract.

In the event of cancellation of tours by Magic Ways, customers may request a refund of their tickets or any package booked.

For cruises subject to navigation regulations, the service provider reserves the right to determine whether or not the river is navigable. Cruises may be cancelled or modified at any time after booking, including on the day of departure, in application of the aforementioned rules, or in the event of bad weather endangering the safety of passengers.

In the event of cancellation of the cruise due to force majeure (flooding, ban on navigation by the authorities, etc.), a discount of 20% of the total amount, excluding options, will be applied.

The trip may be cancelled by the organizer or the agency if the minimum number of participants is not registered:

– 20 days before departure date, for trips lasting more than 6 days.

– 7 days before departure date, for trips lasting 2 to 6 days.

– 48 hours before departure date, for trips lasting 2 days.

The Traveler will then be reimbursed for any sums paid, but will not be entitled to any compensation.

Article 3 – Modification policy

All modifications are subject to availability.

Modification fees vary according to the type of product, the type of modification and the timeframe in which the request is made, as shown in the following table.

Article 4 – Prices

Prices include all services indicated in the description of each tour or service.

Prices are per person and in euros unless otherwise stated.

Prices include VAT.

The prices mentioned on this site are only valid for bookings made directly online.

Promotions mentioned on the site are only valid on the site itself. They cannot be claimed through any other sales channel. They have certain characteristics, in particular dates, which will be mentioned below.

Article 5 – Children’s rates

Children’s prices are valid for ages 2 to 11 inclusive, unless otherwise indicated on the products concerned. In some cases, the age may vary. For further information, please refer to the tour details on the website.
For Disneyland Paris ®, children’s rates are valid for ages 2 to 11 inclusive.

Children under the age of 2 (babies) are free: however, reservations are required to guarantee the availability of a child seat, which is mandatory under French regulations. Babies are not allowed on parents’ laps in minibuses. Meals are not included and require a supplement to be paid on site.

Article 6 – Operations and departure time

  • For excursions departing from our agencies:

For all tours and activities departing from our agencies (Article 15: Our agencies), customers must check in at least 30 minutes before departure time.

Boarding closes 10 minutes before departure time.

  • For Premium excursions in shared or private minibus :

Guests must check in at least 15 minutes before departure in the hotel lobby, or at the main entrance of the building if staying in a private apartment.

  • For tours departing on site :

Customers must arrive at the site at least 15 minutes in advance.

  • For cruise services :

Customers must arrive at least 15 minutes before the boat’s departure time.

We cannot be held responsible for delays caused by events outside our control, such as traffic irregularities, strikes, demonstrations, exceptionally closed establishments or weather warnings.

For operational reasons, we need to know passengers’ local contact details (cell phone number or e-mail address, hotel location), which must be specified at the time of booking (see article 1).

Magic Ways will not use this information for commercial purposes.

Article 7 – Terms of payment

Payment must be made in full at the time of booking, using one of the available payment methods.

Article 8 – Assignment of contract

In accordance with article L. 211-11 of the French Tourism Code, you have the option of transferring the present contract to a person meeting the same conditions as you, as long as it has not produced any effect and up to 7 days before departure, by notifying the agency within a reasonable period of time. You and the beneficiary of the assignment remain jointly and severally liable for payment of the balance of the contract and any assignment fees communicated to you.

Article 9 – Customers with reduced mobility

Only certain excursions are adapted to welcome customers with reduced mobility. We strongly recommend that you always check at the time of booking whether the excursion is suitable for you.

In this case, customers must be accompanied by an able-bodied person. Guides, attendants and coach drivers are not authorized to assist customers with reduced mobility.

It is essential to inform Magic Ways when booking PRM equipment, so that we can offer the best possible service. Otherwise, the passenger may be refused access and returned at his or her own expense.

Since we don’t have any adapted means of transport, the customer must be able to board independently, assisted by a third party.

At the time of booking, information on the type of equipment used must be specified to the Magic Ways reservation department (specify the dimensions of the wheelchair, whether electric or mechanical, and whether it is folding), so that we can offer the most suitable service.

Non-folding wheelchairs will not be accepted on board.

Similarly, guide dogs will only be accepted if Magic Ways is informed at the time of booking and on presentation of the guide dog card.

Article 10 – Liability

The retailer and the organizer are responsible for the proper execution of the services provided for in the present contract and are obliged to provide assistance to the traveler in difficulty.

In the event that the service providers are held liable in their own right, the limits of compensation resulting from international agreements under article L. 211-17-IV of the French Tourism Code will apply; failing this, and except in the case of personal injury, intentional damage or damage caused by negligence, any damages are limited to three times the total price of the trip or stay.

Personal items

Magic Ways and its suppliers cannot be held responsible for the loss or theft of personal items or luggage during transport, visits and excursions, and we cannot undertake to recover or return them.

All costs incurred in this respect shall be borne by the customer.

Only small bags are allowed, in accordance with the regulations applicable to museums and national monuments.

Customers’ luggage may not be left in our agencies or coaches while tours are in progress.

Leaving France

When leaving France, it is the customer’s responsibility to check that they have the necessary documents for their stay: passport with visa if required, or an up-to-date identity card.

Interrupting laps

No reimbursement will be made for any interruption to the tour or service caused by the customer.

The voluntary departure of the Customer will result in Magic Ways being relieved of all obligations and all liability for any incident that may occur from the time of such departure and will result in the Customer waiving all rights of recourse against Magic Ways.

Customer delay

Any delay in excess of 10 min for tours from Paris or Versailles or in excess of 20 min for other destinations will be considered as an interruption of the tour due to the customer’s voluntary departure and will entail the same consequences. Magic Ways would therefore be relieved of all responsibility and the customer would have to return at his own expense”.

Drugs and alcohol

The customer undertakes to behave in a way that does not contravene common sense or the laws and regulations in force, in particular those prohibiting smoking, the consumption of alcohol or the transport of hazardous materials.

Magic Ways reserves the right to disembark any passenger who contravenes the regulations and/or whose behaviour is clearly of such a nature as to put other passengers, the driver or a third party at risk, without the latter being entitled to claim compensation or reimbursement.

We remind you that alcohol abuse is dangerous to your health. Magic Ways cannot be held responsible for the behaviour or accidents of customers who are under the influence of alcohol or drugs, or for any damage they may cause.

Article 11 – Insurance

Magic Ways, headquartered at 18 Rue Royale, 75008 Paris, is registered with the Paris Trade and Companies Registry under SIREN number 327 032 827.

Magic Ways has an insurance policy covering the pecuniary consequences of the civil liability it incurs as a result of its activity, with the HISCOX insurance company, located at 12, quai des Queyries – CS 41177 – 33072 Bordeaux.

Magic Ways is registered with Atout France under number IM075100111.

Article 12 – Information technology and civil liberties

Magic Ways undertakes to respect the confidentiality of personal data provided by the Customer in accordance with the French Data Protection Act no. 78-17 of January 6, 1978. For further information,

Article 13 – Applicable law

The General Terms and Conditions are governed by French law. In the event of a dispute, the matter will be referred to the Paris Commercial Court.

In the event of any dispute as to the content or interpretation of the General Terms and Conditions, drawn up in different languages, or in the event of any conflict, ambiguity, inconsistency or discrepancy between the French version and the version in another language, only the French version shall prevail.

The provisions of these General Terms and Conditions are independent. The annulment of any one of them may result in the annulment of the whole of the General Terms and Conditions, with the exception of the situation where the disputed stipulation in question is considered to be substantial and decisive, and its annulment would call into question the general balance of the present General Terms and Conditions.

In the event that any provision of these General Terms and Conditions is deemed to be insubstantial, Magic Ways undertakes to replace it with an equivalent provision.

Article 14 – Contacts

Requests received at other e-mail addresses will not be considered.

If no satisfactory response is received within 60 days, or if the customer is not satisfied with the response received, the customer may refer the matter free of charge to the Tourism and Travel Ombudsman, whose contact details and procedures are available on the website :
